Tax Collector Files Lawsuit Against Online Travel Companies

RE: TAX COLLECTOR FILES LAWSUIT AGAINST ONLINE TRAVEL COMPANIES

The Constitutional Tax Collector filed a lawsuit against four Online Travel Companies (OTC), also referred to as Third Party Intermediaries, in the Palm Beach County Circuit Court today. Defendants include Air BNB Inc., HomeAway Inc., TripAdvisor LLC, and CouchSurfing International Inc. The lawsuit alleges the OTCs failed to register as dealers of transient accommodations with Palm Beach County and did not pay the county’s tourist development tax as authorized by Florida Statute 125.0104 and 212.0305 and County Codes 17-111, 17-113 and 17-114. A “bed tax” of 5 cents per dollar is levied on all Palm beach County hotel stays for short term rentals of 6 months or less.
The Tax Collector filed the lawsuit seeking a declaratory judgment for tourist development taxes (TDT). TDT taxes are due on amounts received by the named defendants for vacation rentals at private homes in Palm Beach County that they market and collect monies.
